چکیده

ازدواج در فقه امامیه و حقوق ایران به دو قسم دائم و موقت تقسیم می‌گردد. اصل ازدواج در اسلام ازدواج دائم است و ازدواج موقت به‌تبع شرایط اضطراری و راهکار موقت و فرعی قرار داده شده است؛ لکن عدم وجود قوانین شفاف در مورد مجوز ازدواج موقت در ایران باعث شده است که برخی از مردان بدون درنظرگرفتن شرایط اضطرار به سوءاستفاده از آن اقدام و آسیب‌های فراوانی به جامعه و خانواده وارد کنند.هدف پژوهش بررسی اثرات عدم رعایت شرایط جواز ازدواج موقت از سوی مردان متأهل و آسیب‌های آن بر روابط زوجیتی بین همسران دائم و انعکاس این آسیب‌ها بر روی زندگی خانوادگی است.گردآوری اطلاعات از طریق مصاحبه‌های نیمه‌ساختاریافته با زنانی که همسرانشان مبادرت به انجام این امر داشتند انجام گرفت.روش نمونه‌گیری هدفمند و از معیار اشباع نظری استفاده شد.نتایج پژوهش حاکی از آن است که آثار ازدواج موقت مردان متأهل در روابط زوجیتی به آسیب به روابط عاطفی، اختلال در اعتماد بین زوجین، اختلال در امنیت خانواده،آسیب به روابط فیزیکی، اختلال در مدیریت خانواده و در روابط خانوادگی دارای اثرات منفی بر روابط بین اعضای خانواده،ارتباط با آشنایان و دیدگاه اطرافیان نسبت به خانواده و آسیب‌های آن بر زنان چنین مردانی در چهارطبقة آسیب‌های روانی،آسیب‌های فیزیکی،آسیب‌های اقتصادی و آسیب‌های اجتماعی قابل‌تقسیم است. نتیجه آنکه به‌کارگرفتن این نهاد بدون چارچوب و عدم تبیین دقیق شرایط جواز آن از منظر شرع و قانون می‌تواند به عامل تهدید وتضعیف‌کنندة خانواده که دربرخی مواردمنجر به آسیب‌های روانی جبران‌ناپذیری برای همسران چنین افرادی تبدیل و بعضاً فروپاشی خانواده‌ها را به دنبال داشته باشد

چکیده [English]

The principle of marriage in Islam is permanent marriage, and temporary marriage is based on emergency conditions and secondary solution;However, the lack of clear laws regarding the temporary marriage license in Iran has caused some men to abuse it without considering the emergency conditions and cause a lot of damage to the society and family.The aim of the research is to investigate the effects of not complying with the conditions of temporary marriage license by married men and its damages on marital relations between permanent spouses and the reflection of these damages on family life.Data collection was done through semi-structured interviews with women whose husbands agreed to do this.The purposeful sampling method was used and the theoretical saturation criterion was used.The results of the research indicate that the effects of temporary marriage of married men in marital relationships are damage to emotional relationships, disruption of trust between spouses, disruption of family security, damage to physical relationships, disruption in Family management and in family relationships have negative effects on the relationships between family members,communication with acquaintances and the views of those around the family and its harm to women can be divided into four categories:psychological harm, physical harm, economic harm and social harm; therefore,using this institution without The framework and the lack of detailed explanation of the conditions of the permit can become a threat and weaken the family, which in some cases leads to irreparable psychological damage to the spouses and sometimes leads to the collapse of families
